Having A Lawyer Represent You In The Purchase Of Your Fort Lauderdale Real Estate Home Or Condo
July 11, 2008
Even if you have an experienced and professional Realtor working with you on the purchase of your Fort Lauderdale real estate home or condo you may still want to have a good real estate attorney working on your behalf.
While an agent may be able to help you find the home of your dreams, working with a lawyer who is well versed in real estate contracts and transactions can help you avoid a myriad of potential problems down the road.
Why don’t more prospective buyers utilize the services of an attorney? I can’t say for sure but I suspect that they think it would cost too much or they may think they are already working with a real estate agent so they must be protected legally.
Wrong! A real estate agent can not practice or advise you on matters of law. I would not want my Doctor cutting my hair and you as a buyer should never accept or rely upon any legal advice obtained from a real estate agent.
Choosing a good Fort Lauderdale real estate lawyer is can make the entire home buying process run smoothly for you and help you avoid potential financial nightmares. It is best to have an attorney review all real estate contracts and addendums to protect your interests.
Even the best real estate agent falls far short in being able to offer you any such review or protection, unless of course they are also an attorney. Another aspect of involving an attorney where an agent falls short is in the area of attorney-client privilege. A real estate agent may be bound by rules of disclosure. An attorney is bound NOT to divulge certain information. This could be extremely important in protecting the privacy of your real estate transaction.
Real estate contracts are binding and there is a lot of legal terminology in the document that the average lay person, and many real estate agents do not understand. One of the reasons many agents prefer to use the boilerplate contracts that they use is because they knw a couple of things for certain:
a. the contract is uniform and has already been reviewed by the local board
b. the contract ideally protects the agent
Your protection is not guaranteed in a boilerplate contract. Just because an agent tells you it is you can not be sure without an independent review by your own attorney. There are special clauses in a traditional real estate contract that absolves the agent of any liability should the proverbial fan get hit with you know what!
It will not delay your transaction at all to have an attorney review the contract on the purchase of your Fort Lauderdale real estatehome or condo. The cost may be able to be transferred to the closing statement as a part of the closing of the transaction actually saving you any out of pocket expense.
When working with an experienced Buyer’s agent, you should ask them for a referral to a good real estate attorney. When you work with our office we provide you free counsel with a professional real estate attorney.
By agreeing to exclusively work through our office, you get the blanketed coverage of a full team of professionals working on your behalf and no out of pocket expense to you whatsoever. It’s just one of the perks of having our team represent you on the purchase of your Fort Lauderdale real estate home or condo.
Better safe than sorry when buying your new home.
